Terms of Service

§ 1 Scope and provider These Terms of Service apply to the use of the EquiCard service, operated by Digital Crafted GmbH, Quälkampsweg 93a, 22880 Wedel, Germany ("Provider"). Deviating terms of the user apply only with the Provider's express written consent.

§ 2 Subject matter EquiCard is a web-based service for managing a digital horse register (master data, health, documents, calendar, etc.). The scope of functions follows from the current service description. The Provider owes the provision of the service, not a particular economic outcome.

§ 3 Registration and account Use requires an account. The user provides truthful information upon registration and keeps their credentials secret. The user is responsible for all actions taken via their account.

§ 4 User obligations The user must not use the service unlawfully or abusively, must not infringe third-party rights and must not introduce malware. The user is responsible for the accuracy and lawfulness of the data entered and content uploaded.

§ 5 User content The user retains the rights to their content and grants the Provider the simple right of use necessary to operate the service (storing, displaying, processing). The Provider does not adopt third-party content as its own.

§ 6 Prices and payment Where paid services are offered, the prices displayed at the time of order apply, including statutory VAT. Payment and billing details are shown separately. No fees apply during a free beta/test phase.

§ 7 Term and termination The user may end the relationship at any time by deleting the account. Paid subscriptions follow the agreed term. The right to extraordinary termination for good cause remains unaffected.

§ 8 Availability The Provider strives for high availability but does not owe uninterrupted availability. Maintenance, faults or circumstances beyond the Provider's control may cause limitations. The user is co-responsible for keeping their own backups of important data.

§ 9 Liability The Provider is liable without limitation for intent and gross negligence and for injury to life, body or health. For simple negligence the Provider is liable only for breach of material contractual obligations and limited to the foreseeable damage typical for the contract. Otherwise liability is excluded. Liability under the German Product Liability Act remains unaffected.

§ 10 Data protection The processing of personal data is governed by the Privacy Policy.

§ 11 Changes to the Terms The Provider may amend these Terms with effect for the future where necessary and where this does not unreasonably disadvantage the user. Users are informed of material changes in good time.

§ 12 Final provisions German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer-protection rules of the user's country of residence remain unaffected. Place of jurisdiction, where permitted, is the Provider's registered office. Should a provision be invalid, the validity of the remaining provisions is unaffected.
